Chick and Duckling Rental Agreement & Liability Waiver

Equipment Provided
The following equipment is provided for the purpose of chick/duckling hatching and/or care:
- Incubator and packaging box (only applicable for hatching package)
- Heating Plate
- Cage/Feeder and Waterer/Feed/Gloves/Light/Hygrometer
- Fertilized Chicken Eggs or Duck Eggs (only applicable for hatching package)
- Care Instructions & Educational Materials
Curbside Pickup and Dropoff Policy
All pickups and dropoffs are curbside only. No renter or visitor is permitted on or inside the premises. Renters must:
- Call upon arrival
- A staff member will bring out all equipment and place it in or beside your vehicle during pickup and will take the equipment during dropoff.
Acknowledgment of Risk
By accepting this agreement, the renter understands and agrees that:
- Live poultry, including chicks and ducklings, may carry harmful bacteria, including Salmonella.
- There is a known risk of illness from handling chicks, ducklings, or equipment, and contamination to surroundings even with proper care.
- The renter accepts full responsibility for ensuring all individuals in contact with the animals or equipment use proper hygiene and safety precautions.
- The renter voluntarily assumes all risks, including:
- Zoonotic disease exposure (e.g. Salmonella)
- Foodborne illness
- Injuries from animal handling or equipment use
- Property damage
- Emotional or educational distress resulting from animal death or unhatched eggs
- Children must be supervised at all times when near chicks, ducklings, or equipment.
- There will be no direct contact with chicks, ducklings, or other animals at any time. This is to prevent the transmission of disease and protect the health of both the animals and individuals involved.
- Not all eggs will hatch, and chick or duckling mortality can occur-no guarantee is made on hatch rate or survival.
- The renter acknowledges that full instructions have been provided for safe use of all equipment.
Waiver & Release of Liability
The renter hereby waives, releases, and holds harmless Hatchables.ca Inc., its owners, employees, volunteers, contractors, and affiliates from any and all liability, claims, losses, or damages, including legal fees, arising from:
- Illness (including salmonella or other zoonotic or foodborne disease)
- Injury or harm to persons or property
- Malfunction or misuse of equipment
- Emotional harm due to chick or duckling loss or failed hatching
- Any claim made by third parties as a result of this rental
This waiver applies to all participants interacting with chicks, ducklings, or equipment under the renter’s care.
Equipment Terms
- Equipment must be returned clean and in working condition.
- Damage or loss will be billed at the full replacement cost.
- Equipment remains the property of Hatchables.ca Inc. at all times.
- Late return is subject to a $50 per day penalty and issuance to collection if beyond 7 days late, unless otherwise agreed to in writing by Hatchables.ca Inc.
Agreement Acceptance
By checking the required agreement box in the Hatchables cart, the renter confirms they have read, understood and agree to these terms. If booking on behalf of an organization, school or group, the renter confirms they are authorized to accept these terms on its behalf.
When you check the required rental-agreement box in the Hatchables cart and continue to checkout, Hatchables records this agreement version and the acceptance date/time with the order.
